After receiving a ban following a stream where he viewed the Olympics, xQc decided to fight back and take on Twitch in the battle for fair use.
xQc, one of the most popular streamers on Twitch right now, got another ban on Twitch a short while ago. Now he’s come out to say that he’ll be fighting the ban by contesting the DMCA claim he received a while ago, which he went on to confirm was due to him viewing the Olympics on his stream. “We issue a counterclaim, which is pretty ballsy. A counterclaim is like, they strike me and it’s me saying that no, I’m right.”
In his most recent stream xQc also explained the reasoning behind his ban and basically confirmed the speculation that it was about viewing the Olympics. “I was viewing the Olympics and doing some react content, then I got striked. Normally strikes don’t get you banned, but because it’s a live strike they ban you, to prevent you from doing any further damage.”
What xQc is basically saying by contesting the initial DMCA claim is that his liveviewing content is transformative content and, on that note, is transformative enough to be deemed fair use.
In any case, it’s clear this story isn’t over and we’ll likely be getting an update on the situation very soon. With the current DMCA landscape over on Twitch, it might be necessary for a big streamer such as xQc to take a stand if he thinks he’s in the right. On the other hand, it’s hard to say if viewing the Olympics is the hill to die on. Just like xQc said during his stream: “If this escalates, it can get crazy.”
